The Missouri Supreme Court today declined to hear an appeal related to the downtown streetcar line, ending a legal challenge to the project.
A downtown property owner had appealed after a Jackson County judge and the appeals court in Kansas City dismissed her lawsuit.
Sue Anne Burke sued long after a Jackson County judge last year held hearings and found the project constitutional.
The lawsuit did not come until after downtown voters approved the transportation district, along with sales and property tax increases for the $100 million, two-mile starter line from the River Market to Union Station.
A Jackson County judge and the appeals court ruled that any such appeal should have been filed after the first judge ruled the election proper last year, not after the actual election.
The appeals court ruling supported Jackson County Judge Peggy Stevens McGraw’s dismissal of the lawsuit.
“We also conclude that the Appellants could have and should have, raised their claims in the Formation lawsuit,” the appeals court ruled.
